African Travel Crew strive to ensure that our clients travel expectations are matched with the appropriate and compatible local travel operators to ensure memorable travel experiences.
In order to ensure a clear understanding between ourselves and to clarify our relationship, these terms and conditions have been formulated. They will govern our relationship and the terms of the services offered and accepted, so please ensure that you have familiarized yourself with them sufficiently before entering into a contract with us as by doing so you will be bound by these terms and conditions.
1. DEFINITIONS
‘African Travel Crew’ or the ‘Company’– refers to African Travel Crew (Pty) Ltd a private company duly incorporated and registered according to the company laws of the Republic of South Africa , Registration Number : 2024/392723/07
“Client” – refers to the person/s who is/are named and identified on the booking form as the confirmed party/ies embarking on the trip or excursion and by being so named or identified therein, they agree to contract with African Travel Crew and to be bound by these terms and conditions, notwithstanding that not all the person/s embarking on the trip or excursion might have signed the booking form which may have been completed by an agent, in which case such agent will be similarly bound. All such person/s named in the booking form shall be jointly and severally liable for the due performance of their obligations in terms hereof and agree to be bound by the terms and conditions contained herein. All legal guardians of minors warrant that they have consented to those minors accompanying them on any trip or excursion contemplated herein and are aware of, and accept on behalf of the minor, all or any attendant risks, which are undertaken under the sole control and supervision of any such guardian or guardians.
“Trip” – refers to any tour, excursion, safari or similar booking made with African Travel Crew and as described on the booking form and itinerary attached thereto, as the case may be.
“Quotation” – the written document supplied to you by African Travel Crew and marked as such, valid for 30 days from the date appearing thereon for the specified purpose, this constituting an invoice for goods and services supplied or/to be supplied as the case may be.
“Services” – refers to and includes but is not limited to, the trip as well as the procurement of accommodation, transport, and transfers by African Travel Crew on behalf of the client with third-party suppliers of various establishments relating to the travel industry and including all services incidental thereto.
“You or Your” – refers to the client as defined.
“Supplier/s” – refers to the third-party agent with whom African Travel Crew books services on behalf of the client, including but not limited to tour operators, shuttles, accommodation establishments, safaris and the like.
“Contract” – refers to the contractual agreement between the client and African Travel Crew upon the clients acceptance of the quotation from African Travel Crew.
“Force Majeure” – means in relation to the Company, any circumstances beyond the reasonable control of the Company (including, but not limited to, acts of God, explosion, flood, fire, war or threat of war, sabotage, civil disturbance, quarantine, government intervention, weather conditions or other unexpected occurrences).
The headings to the clauses in these Terms and Conditions are for reference purposes only and shall not govern their interpretation.
Any reference to the singular shall include a reference to the plural and vice versa and any reference to gender includes a reference to all genders and any reference to natural persons will include a reference to legal entities.
2. TRAVEL INSURANCE
2.1. The purchase of sufficient comprehensive travel insurance by the client is mandatory and must be confirmed at the time of your booking, to the reasonable satisfaction of African Travel Crew.
2. Should you fail to obtain comprehensive travel insurance timeously for any reason whatsoever, all or any costs arising from the consequent possible need to cancel, re-route or effect different travel arrangements including an emergency medical procedure will be for your own cost. You hereby indemnify African Travel Crew wholly from any harm, loss or damages that you or your heirs or assigns may suffer as a result of any such failure.
3. BOOKING PROCEDURE
3.1. In order to secure your reservation, a 30% (thirty per cent) deposit will be paid to African Travel Crew simultaneously with the time of reservation of the booking and submission of the completed booking form. Failure to do so timeously will result in the automatic cancellation of your provisional booking. Should there be an increased deposit required by service providers to African Travel Crew you will be notified accordingly.
3.2. The remaining balance of payment amounting generally to 70% (seventy per cent) must be paid to to African Travel Crew no less than 60 days prior to the commencement of your booking, if you have however booked your trip within 60 days of departure, the full payment must be paid on the date of reservation in order to secure your booking.
3.3. African Travel Crew charges a 4% booking service fee for all reservations. However, African Travel Crew undertakes to waive this fee should you elect to pay by direct deposit.
3.4. Should you be quoted by us in a foreign currency, payment to us will need to be made in either South African rands (ZAR), Euro (EUR) or United States dollars (USD) and African Travel Crew will advise you in which currency payment is to be made as the election in this regard lies solely within the discretion of African Travel Crew. Any bank charges incurred as a result of such a payment or foreign exchange fluctuations/variations will be for your account, irrespective of the method of payment chosen.
3.5. African Travel Crew reserves the right to cancel reservations should your deposit or balance of payment not be timeously received.
3.6. African Travel Crew reserves the right to increase a quotation before receipt of payment should African Travel Crew’s supplier’s increase the prices, not withstanding that the quotation as already been issued. The updated prices will be posted on the African Travel Crew website as soon as possible after notification by the supplier.
3.7. Should some increases in pricing occur over which neither we as the agent nor the suppliers have any control, irrespective of whether you have paid in full for your booking, you will be liable for these increases and will be billed accordingly. (This can occur as a result of several factors including, but not limited to, government tax increases that affect tourism-related services, park fee increases and the like.)
4. WAIVER, INDEMNITY AND LIABILITY
4.1. African Travel Crew acts as agents between your and its suppliers to secure the best booking for you as a client. African Travel Crew however cannot be held responsible for any defects or cancellations or defects to the bookings or trips, which includes, but is not limited to, delays, loss or damages arising from any causes whatsoever, including dissatisfaction with the booking, or any loss, damage or delay caused by the suppliers or any third party providing services to African Travel Crew.
4.2. All vouchers, tickets and receipts issued by the supplier, tour operator or any third party providing services to African Travel Crew will be subject to their own specific terms and conditions. You hereby undertake to abide by any such specific terms and conditions and in doing so acknowledge that you participate on the entire trip or any related excursion at your own risk and personal liability for any attendant loss or damage caused to you for any reason or by any cause whatsoever.
4.3. You furthermore hereby indemnify and hold harmless African Travel Crew, its directors, staff, employees, agents and assigns against any claim for loss or damage of whatsoever nature that may arise or have arisen in connection with any services supplied or offered by or in connection with them pursuant to this contract.
4.4. You hereby indemnify and hold harmless African Travel Crew from any alleged claim or claims which you, your agent, executor, heirs or assigns may have for compensation for damages or loss of whatsoever nature and from any cause howsoever arising resulting from injury or any loss occasioned of whatsoever nature, and furthermore hereby irrevocably waive any and all such claim including but not limited to any transportation to, from or during the trip or any related excursion as well as in respect of any illness, injury or death arising during or after the trip or any related excursion.
4.5 You should note that all activities are undertaken at your own risk and African Travel Crew shall not be held liable for any harm sustained by you pursuant to any activities undertaken by you in terms hereof, consequent upon which it is incumbent upon you to ensure that you maintain adequate Insurance with particular reference, but not limited to, you undertaking one or other of the following activities: Rock Climbing, Extreme Sports (including but not limited to bungee jumping, parasailing or hang gliding) Horse Riding, Canopy Tours, Scrambling Activities, Mountain Biking, Quad Biking, Aviation, Coastal Water & Airborne Activities including Snorkelling and Scuba Diving.
Furthermore you should at all times be vigilant and adhere to any instructions from operators in relation to the afore mentioned activities which you embark on at own risk. You are also urged to bear in mind that on Safari the animals are not domesticated and African Travel Crew will not be held liable for any injuries or injuries suffered pertaining to any incidents involving Lions, Rhino, Hippo, Buffalo, Leopard, Elephants or any other Wildlife, in respect of which you hereby indemnify and hold harmless African Travel Crew.
4.6 Kindly note that as a General Exclusion African Travel crew shall not be responsible or liable for any damages or losses sustained by you as a consequence of any Force-Majeure event, acts of Terrorism, Sexual Molestation, Internet Cyber Liability.
4.7 War and Civil War Exclusion Clause
You hereby indemnify and hold harmless African Travel Crew against any liability arising directly or indirectly out of:
(i) civil commotion, labour disturbances, riot, strike, lockout or public disorder or any act or activity which is calculated or directed to bring about any of the aforegoing;
(ii) war, invasion, act of foreign enemy, hostilities or warlike operations (whether war be declared or not) or civil war;
(a) mutiny, military uprising, military or usurped power, martial law or state of siege, or any other event or cause which results in the proclamation or maintenance or martial law or state of siege;
(b) insurrection, rebellion or revolution;
(iii) any act (whether on behalf of any organisation, body or person, or group of persons) calculated or directed to overthrow or influence any State or Government, or any provincial, local or tribal authority with force, or by means of fear, terrorism or violence;
(iv) any act which is calculated at or directed to bring about loss or damage in order to further any political aim, objective or cause, or to bring about any social or economic change, or in protest against any State or Government, or any provincial, local or tribal authority, or for the purpose of inspiring fear in the public, or any section thereof;
(v) any attempt to perform any act referred to in Clause (iv) or (v) above;
(vi) the act of any lawfully established authority in controlling, preventing, suppressing or in any other way dealing with any occurrence referred to above.
(viii) by or through or in consequence of any occurrence for which a fund has been established in terms of the War Damage Insurance and Compensation Act, 1976 (No. 85 of 1976) or any similar Act operative in any of the territories to which this policy applies.
The aforementioned provisions notwithstanding, should the Client allege for any reason that any loss or damage occasioned as a consequence of one or other of the aforementioned events or acts should be borne by African Travel Crew, the burden of proof of legal liability, causality and the quantum of damages allegedly suffered shall rest on the Client.
5. CANCELLATION AND REFUND POLICY
5.1. All cancellations must be effected in writing and receipt thereof acknowledged in writing by African Travel Crew in order to constitute a valid cancellation.
5.2. Cancellation of bookings is subject to the following conditions:
5.2.1 More than 61 days before booking, the deposit is non-refundable.
5.2.2 60 days or less before the booking, 100% cancellation fee without refund.
5.3. We shall endeavour to confirm your booking as soon as possible after receipt of payment of the deposit however should we fail to secure this booking for any reason whatsoever, we shall strive to procure alternative booking arrangements. Should these alternative arrangements not be suitable for you, African Travel Crew will refund your payment, subject to the terms and conditions of the supplier with whom the booking was made.
5.4. You will not be entitled to refunds for a no-show or a partially used booking.
5.5. In the event of a misquotation being made by African Travel Crew, we reserve the right to cancel a booking without any liability to African Travel Crew or the client; provided that should the the misquotation result in a cost implication to the client any payment already made will be refunded to you. This not withstanding, African Travel Crew will not be held liable for any error on our website, brochures or other advertising and marketing material, and reserves the right to correct same once any such error has been brought to our attention, which may result in the cancellation of a booking and refund of any payment already made, without any liability arising on behalf of African Travel Crew.
5.6. Should any errors occur on our website, brochures or other advertising or marketing material with regard to pricing, African Travel crew reserves the right to correct it as soon as it is brought to our attention and shall not be held liable for or bound by any such error.
5.7 African Travel Crew shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the Client, by reason of any delay in performance, or by non-performance, of any of its obligations in terms hereof and to the extent that any such delay or non-performance is due to any Force Majeure.
5.8. Should African Travel Crew in anyway be affected by Force Majeure it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary, arrangement or excursion in relation to any tour, excursion, safari, or similar booking made with African Travel Crew and as described on the booking form and itinerary attached thereto.
6. COMPLAINTS AND DISPUTE RESOLUTION
6.1. Any complaints must be addressed in writing to African Travel Crew via email to hello@africantravelcrew.com or post to 27 Mount Rhodes Drive, Hout Bay, Cape Town, South Africa, 7806, for the attention of the Managing Director.
6.2. African Travel Crew shall use its best endeavours thereto within 30 days of receipt of your complaint and will make every effort to resolve any dispute after investigation with the relevant supplier and this response will be communicated to you as soon as possible. As we act only as agents, however, it cannot be guaranteed that any dispute will be resolved to your satisfaction as the resolution thereof may be beyond the control of African Travel Crew.
7. PASSPORTS AND VISAS
7.1. It is your responsibility to ensure that all your travel documents are in order and up to date and immigration regulations such as visas and/or permits are satisfactorily obtained and in your possession for travel purposes. It is advisable that you contact the consulate or embassy of your destination country as well as any countries through which you will be passing, in order to verify the requirements and ensure that you are adequately prepared. African Travel Crew will countenance or entertain any refund/s consequent upon incomplete travel documentation.
7.2. Be advised further that your passport must have sufficient blank visa pages available as per the regulations of the various African countries. It is recommended that a minimum of 2 (two) blank pages (opposite each other) per country that you will be visiting or passing through be available in your passport. Furthermore, your passport must be valid for the prescribed period as contained in the applicable regulations of the African countries you will be visiting or passing through. This is generally 3 months validity post proposed trip.
7.3. If you are travelling with a minor child, you will need their unabridged birth certificate and if only one parent is travelling with the minor, you will need to provide a letter of consent from the absent parent that the minor is allowed to travel with you.
7.4. This is not a comprehensive list of the required travel documents and should not be construed as such.
7.5 We reiterate that it is advisable that you contact the consulate or embassy of your destination country as well as any countries through which you will be passing, in order to verify the requirements and ensure that you are adequately prepared.
8. CHANGES TO TRAVEL ITINERARIES
8.1. We will present you with an itinerary, however note that travel through Africa is intended to be filled with adventure, excitement, spontaneity and memorable moments. This can result in the itinerary being a mere guideline for your trip and may be subject to change as there are many factors and conditions beyond the control of African Travel Crew and the supplier, including but not limited to extreme weather, political conditions, outbreak and road passability which may lead to changes in your itinerary.
8.2. Should alternative arrangements be deemed or in fact become necessary, African Travel Crew will endeavour to provide this as conveniently and cost effectively as possible, however this may ocassion additional costs for which you are liable. Should alternative arrangements not be possible, African Travel Crew will endeavour to refund you the portion of unutilised services, subject to African Travel Crew being able to recover from the supplier. Similarly, should you choose not to partake in the alternate itinerary, African Travel Crew will endeavour to refund you as stated above, however again subject to African Travel Crew being able to recover from the supplier.
8.3. Should it be necessary to arrange alternative or additional transport to the end destination of the trip, African Travel Crew will assist where possible and any additional cost of procuring such transport will be for your account.
9. INNOCULATION, IMMUNIZATION AND MEDICATION
9.1. African countries have varying inoculation, immunization and medication requirements and it is essential that you familiarise yourself with these and take the necessary action timeously as travel will not be permitted unless you meet these requirements which are and shall remain your full responsibility. It is furthermore your responsibility to be familiar with all diseases, both real and potential, when travelling to and through Africa to take the necessary precautions and to ensure that you have had the appropriate vaccinations. It is your responsibility to ensure that you check in terms of your domicile country for any additional inoculations that you may require upon your return, since although your destination country may not require certain inoculations, on your return there may be additional requirements as prescribed by your domicile country.
9.2. It is also your responsibility to ensure that you are medically fit and healthy for travel and in some cases, you may be required on request to provide a medical statement from a medical practitioner to confirm that you are fit and healthy to travel.
10. ILLNESS OR DISABILITY
10.1. If you are suffering from any illness or disability, or are undergoing any medical treatment, you must declare this openly and honestly to African Travel crew at the time of booking your trip. Similarly, if you are affected by any condition that may affect you or others during your trip in any way, you must comprehensively advise African Travel Crew thereof at the time of your booking.
10.2. It is your responsibility to make arrangements for the provision of any medication or treatment while you are away
10.3. Failing to declare any conditions, illnesses, disability or the like, will constitute a breach of these terms and conditions and may result in you being excluded from any tour, excursion, safari, or similar booking made with African Travel Crew and as described on the booking form and itinerary attached thereto, without refund of any payment.
11. AUTHORITY OF TOUR LEADER/CREW
11.1. The tour leader/crew occupies a position of authority and responsibility in relation to you as the client and for the peace of mind and safety of everyone on the trip, must be obeyed and his/her directives adhered to at all times. By booking the trip, you agree to be bound by the guidance, directives and leadership decisions of the tour leader/crew at all times.
11.2. It is likewise your obligation to behave responsibly throughout the trip and any illegal, unwarranted, or inappropriate behaviour on your behalf and/or any behaviour which constitutes a nuisance may result in your trip being terminated with immediate effect without any refund. Familiarise yourself with local customs and laws in the country you are visiting and respect same, notwithstanding that they may differ either marginally or substantially from your country of origin.
12. GENERAL LEGALITIES
12.1. All the terms and conditions governing your trip and the contractual relationship between you and the African Travel Crew are set out in this document that you have agreed to upon completion of your booking form. These terms and conditions will prevail in the event of any contradiction in any other document so please ensure your familiarity with them as you have agreed to be bound hereby. No party shall be bound by any express or implied terms, representation, promise or the like not recorded herein.
12.2. No variation, amendment, addition or deletion of these terms will be binding unless expressly agreed to by both parties, the client and African Travel Crew, in writing. From time to time, updated and amended terms and conditions will be necessitated due to changes in policy, administration and legislative alterations. Kindly ensure that you are familiar with the most recent document.
12.3. No relaxation or indulgence afforded by African Travel Crew to the client will constitute a waiver of its rights embodied in these terms and conditions. Should any of the terms and conditions herein be deemed to be invalid or null and void as determined by a court of law, the remaining provisions will remain in full force and effect as if the former had not been included.
12.4. The terms and conditions of this agreement and supporting documents will be governed by the Laws of the Republic of South Africa and shall only be enforceable within the Republic of South Africa and its Courts.
12.5. The parties hereby consent to the jurisdiction of the Magistrates Court of South Africa in respect of any action or proceedings which may be brought, notwithstanding that the matter may, but for the aforegoing, fall outside of the jurisdiction of the Magistrates’ Court, provided that African Travel Crew shall, within its sole and unfettered discretion, be entitled to institute any such proceedings in any High Court of South Africa.
12.6. In the event that African Travel Crew institutes proceedings to recover costs, the costs of recovery and all associated costs will be for your account on an attorney and own client scale.
12.7. No responsibilities, rights or obligations in terms of these terms and conditions shall capable of being assigned or ceded by you to a third party.
12.8. Should African Travel Crew be prevented from carrying out any of its obligations in terms of this agreement due to causes beyond its control, including but not limited to the client’s failure to comply with any its obligations imposed in terms hereof, and African Travel Crew shall not be held liable to continue with its obligations while the causes persist and nor shall it be held liable for any delays or losses or damages which may be incurred as a result of any such cause or breach.
13. DOMICILIIUM AND NOTICES
13.1. The parties choose domicilium citandi et executandi (domicilium address) to give any notice, the payment of any sum, the serving of any process and for any other purpose arising out of these terms and conditions and any ancillary documents, their addresses as follows:
African Travel Crew – 27 Mount Rhodes Drive, Hout Bay, Cape Town, South Africa, 7806. The client – the physical address as provided on the booking form.
13.2. The parties will be entitled by written notice to the other to change their aforementioned domicilium address provided same is done no later than seven days prior to the giving of any notice, the payment of any sum, the serving of any process or for any other purpose arising out of these terms and conditions and any ancillary documents and that such change is acknowledged in writing by the other party receiving such notice.
